Default & Past Due Policy
Fency puts a lot of trust in our members by giving everyone a fair chance to tackle their debt regardless of their credit score or history. We expect that there will be times that you may not fulfill your payment obligations to Fency for whatever reason. This page outlines what happens if your account is delinquent.
We've been unable to debit funds from your primary checking account
Fency will make multiple, staggered attempts to collect past due and/or delinquent amounts and fees from your checking account. When that fails, we will attempt to charge any account we are aware of by initiating a draft at any linked financial institution we see fit on any date we so choose.
Fency reserves the right to settle your past due balance at any financial institution you are the account holder of in one lump sum, or in several transaction among multiple accounts or institutions until the debt is settled. This includes, but is not limited to, credit cards, checking accounts, money market accounts, savings accounts, or lines of credit.
Fency is not liable for any fees, overdrafts, or interest caused by it's rightful collection of monies owed to us. Every attempt to do this is an attempt to collect a debt.
Fency reserves the right to report debt delinquencies to credit bureaus at its discretion according to law.
Collections
Fency reserves the right to place your account in collections and possibly refer the unpaid amount to a debt collection service at its discretion. Any amounts sent to collections will dramatically impact your credit score.
Bottom line
We're really nice people, and our goal is to truly help you get out of debt. If you're having trouble, or think you may soon have trouble with your finances...reach out to us. One strike rule
We really trust you on day one to pay your bills. If your account reaches the delinquency stage. We will no longer trust you again. Ever.
Once we're done collecting the outstanding amount you owe us, your account will be closed and participation in the Fency program will cease forever. We will never re-instate your account or help you with paying off debt in the future no matter how much you need it or get your financial affairs in order.
If that is too much for you to agree to at this time, you may log out and stop use of the Fency service until you think you can make all the minimum payments on your debts. We'll be waiting and you can pick up where you left off any time in the future.
